How Overtime is Calculated in South Africa

Overtime pay in South Africa is governed by Section 10 of the Basic Conditions of Employment Act (BCEA). The law sets minimum rates that employers must pay for hours worked beyond the ordinary working week — and separate rates for work on Sundays and public holidays under Section 16.

The BCEA protections apply to employees earning below the earnings threshold of R269,600.90 per year (R22,466.74 per month), effective 1 May 2026. Employees above this threshold have their overtime terms governed by their individual employment contracts rather than the BCEA minimum.

An employee earns R15,000 gross per month, works a standard 45-hour week, and in a given week works 6 hours of weekday overtime and 4 hours on a Sunday.

Step 1 — Calculate the normal hourly rate

BCEA Overtime Limits You Need to Know

The BCEA does not just set the rate — it also caps how much overtime you can be required to work. These limits protect employees from excessive working hours:

  • Maximum overtime: 10 hours per week
  • Maximum per day: 3 hours of overtime in any single day
  • Maximum daily total: 12 hours in any one day (including normal and overtime hours)
  • Overtime by agreement only: An employer cannot unilaterally require overtime — it must be agreed upon between employer and employee
  • 4-month averaging: By written agreement, overtime can be averaged over a period not exceeding 4 months

Time Off In Lieu of Overtime Pay (TOIL)

Instead of paying overtime at the applicable rate, an employer and employee can agree in writing to grant paid time off — commonly called TOIL (Time Off In Lieu). The BCEA sets a minimum for this arrangement:

  • For weekday overtime at 1.5×: at least 1.5 hours of paid time off for each overtime hour worked
  • For Sunday/public holiday overtime at 2×: at least 2 hours of paid time off for each hour worked

The TOIL must be taken within one month of the overtime being worked. This arrangement must be agreed to in writing and cannot be imposed by the employer.

The BCEA Earnings Threshold — Does Overtime Apply to You?

The BCEA earnings threshold was updated to R269,600.90 per year (R22,466.74 per month) with effect from 1 May 2026. Employees earning below this threshold are automatically entitled to all BCEA overtime protections. Employees earning above this threshold have their overtime terms governed by their individual employment contracts.

If you earn above the threshold but your contract states that overtime is payable at BCEA rates — that contract term is valid and your employer is bound by it. If your contract is silent on overtime, your employer is not legally required under the BCEA to pay you overtime at 1.5× or 2× rates.
