How Overtime is Calculated in South Africa

Overtime pay in South Africa is governed by Section 10 of the Basic Conditions of Employment Act (BCEA). The law sets minimum rates that employers must pay for hours worked beyond the ordinary working week — and separate rates for work on Sundays and public holidays under Section 16.

The BCEA protections apply to employees earning below the earnings threshold of R269,600.90 per year (R22,466.74 per month), effective 1 May 2026. Employees above this threshold have their overtime terms governed by their individual employment contracts rather than the BCEA minimum.

Step-by-Step Manual Calculation Example

An employee earns R15,000 gross per month, works a standard 45-hour week, and in a given week works 6 hours of weekday overtime and 4 hours on a Sunday.

Step 1 — Calculate the normal hourly rate

/* Monthly salary ÷ 4.333 (avg weeks/month) ÷ weekly hours */ R15,000 ÷ 4.333 ÷ 45 = R76.92 per hour

Step 2 — Calculate weekday overtime pay

/* 1.5× rate × hours */ R76.92 × 1.5 = R115.38 per hour R115.38 × 6 hours = R692.31 weekday overtime pay

Step 3 — Calculate Sunday pay

/* 2× rate × hours */ R76.92 × 2 = R153.85 per hour R153.85 × 4 hours = R615.38 Sunday pay

Step 4 — Total overtime pay

R692.31 + R615.38 = R1,307.69 total overtime pay
Item Calculation Amount
Normal hourly rateR15,000 ÷ 4.333 ÷ 45R 76.92/hr
Weekday overtime rate (1.5×)R76.92 × 1.5R 115.38/hr
Sunday rate (2×)R76.92 × 2R 153.85/hr
Weekday overtime pay (6 hrs)R115.38 × 6R 692.31
Sunday pay (4 hrs)R153.85 × 4R 615.38
Total overtime payR 1,307.69

BCEA Overtime Limits You Need to Know

The BCEA does not just set the rate — it also caps how much overtime you can be required to work. These limits protect employees from excessive working hours:

  • Maximum overtime: 10 hours per week
  • Maximum per day: 3 hours of overtime in any single day
  • Maximum daily total: 12 hours in any one day (including normal and overtime hours)
  • Overtime by agreement only: An employer cannot unilaterally require overtime — it must be agreed upon between employer and employee
  • 4-month averaging: By written agreement, overtime can be averaged over a period not exceeding 4 months

Time Off In Lieu of Overtime Pay (TOIL)

Instead of paying overtime at the applicable rate, an employer and employee can agree in writing to grant paid time off — commonly called TOIL (Time Off In Lieu). The BCEA sets a minimum for this arrangement:

  • For weekday overtime at 1.5×: at least 1.5 hours of paid time off for each overtime hour worked
  • For Sunday/public holiday overtime at 2×: at least 2 hours of paid time off for each hour worked

The TOIL must be taken within one month of the overtime being worked. This arrangement must be agreed to in writing and cannot be imposed by the employer.

The BCEA Earnings Threshold — Does Overtime Apply to You?

The BCEA earnings threshold was updated to R269,600.90 per year (R22,466.74 per month) with effect from 1 May 2026. Employees earning below this threshold are automatically entitled to all BCEA overtime protections. Employees earning above this threshold have their overtime terms governed by their individual employment contracts.

If you earn above the threshold but your contract states that overtime is payable at BCEA rates — that contract term is valid and your employer is bound by it. If your contract is silent on overtime, your employer is not legally required under the BCEA to pay you overtime at 1.5× or 2× rates. Negotiating these terms before signing your contract is critical for higher-earning employees.

Overtime on Sundays and Public Holidays — Different Rates Apply

Standard overtime (1.5x or 2x for weekday/Saturday work beyond ordinary hours) is different from work performed on a Sunday or public holiday, which the BCEA treats as a separate category regardless of whether it falls within your normal weekly hours. Under Section 16, an employee who occasionally works on a Sunday must be paid double their normal wage for that day's work; if Sunday work is a regular part of your role (built into your ordinary working days), the rate drops to 1.5x instead. Public holiday work follows a similar principle under Section 18 — you're entitled to double pay for hours worked on a public holiday that falls on a day you would not normally have worked, or your ordinary daily wage plus the amount earned for the hours actually worked if it falls on a day you would have worked anyway.

Can Your Employer Force You to Work Overtime?

No — overtime must be agreed to, either in your original employment contract or at the time it's requested. An employer cannot unilaterally instruct you to work overtime without your consent, and refusing reasonable overtime requests is not, on its own, grounds for disciplinary action unless your contract specifically requires it (common in roles like security or healthcare with rostered shift patterns). That said, once agreed to — whether via a standing clause in your contract or a one-off request you accept — overtime becomes enforceable like any other term of employment, and the BCEA's 10-hour weekly cap still applies regardless of what you agreed to.

Frequently Asked Questions

What is the overtime rate in South Africa?
Under the BCEA, weekday and Saturday overtime must be paid at 1.5 times your normal hourly rate. Work on Sundays (where Sunday is not an ordinary working day) and on public holidays must be paid at 2 times your normal hourly rate. These are minimum rates — your employer may pay more.
How do I calculate my hourly rate from my monthly salary?
Divide your monthly salary by 4.333 (the average number of weeks per month) and then by your ordinary weekly hours. For example: R15,000 ÷ 4.333 ÷ 45 hours = R76.92 per hour. This is the hourly rate used to calculate all overtime payments.
How many overtime hours can I be required to work in South Africa?
The BCEA caps overtime at 10 hours per week and 3 hours per day for employees earning below the earnings threshold of R269,600.90 per year (R22,466.74/month), effective 1 May 2026. No employee may work more than 12 hours in a single day including both normal and overtime hours. Overtime must be agreed upon — an employer cannot unilaterally require it.
Can I take time off instead of overtime pay?
Yes, by written agreement. Time Off In Lieu (TOIL) must be at least equivalent to the overtime rate applied to the hours worked — 1.5 hours off for every weekday or Saturday overtime hour, or 2 hours off for every Sunday or public holiday hour. The time off must be taken within one month of the overtime being worked.
Is overtime taxed in South Africa?
Yes. Overtime pay is treated as normal income for PAYE purposes. Your employer adds your overtime earnings to your regular salary when calculating your monthly PAYE deduction. There is no special tax treatment for overtime — it is taxed at your marginal income tax rate. Use our PAYE Calculator to see how overtime affects your take-home pay.
Does overtime apply if I earn above the BCEA threshold?
If you earn above R269,600.90 per year (R22,466.74 per month), effective 1 May 2026, the BCEA overtime provisions do not automatically apply. Your overtime entitlement is then governed by your individual employment contract. Many employers voluntarily apply BCEA rates to all staff regardless of earnings level — check your contract.
Are senior managers excluded from overtime rules in South Africa?
Yes. Under BCEA Section 6, senior managerial employees are excluded from the working time provisions — including overtime — regardless of how much they earn. This exclusion applies to employees who can determine their own hours of work and have the authority to represent the employer in dealings with staff or clients. Most regular employees, including supervisors who don't meet this test, remain covered.
What can I do if my employer doesn't pay overtime I'm owed?
Raise it with your employer or HR first, in writing, referencing the specific hours worked. If unresolved, you can refer an unpaid-overtime dispute to the CCMA, or to the Department of Employment and Labour for a compliance inspection. Keep your own record of hours worked — clock-in records, timesheets, or messages — as supporting evidence, since the burden of proving hours worked often falls on the employee.
