BCEA Overtime Limits You Need to Know
The BCEA does not just set the rate — it also caps how much overtime you can be required to work. These limits protect employees from excessive working hours:
- Maximum overtime: 10 hours per week
- Maximum per day: 3 hours of overtime in any single day
- Maximum daily total: 12 hours in any one day (including normal and overtime hours)
- Overtime by agreement only: An employer cannot unilaterally require overtime — it must be agreed upon between employer and employee
- 4-month averaging: By written agreement, overtime can be averaged over a period not exceeding 4 months
Time Off In Lieu of Overtime Pay (TOIL)
Instead of paying overtime at the applicable rate, an employer and employee can agree in writing to grant paid time off — commonly called TOIL (Time Off In Lieu). The BCEA sets a minimum for this arrangement:
